Terms of Service

Effective date: July 2, 2026

These Terms of Service ("Terms") govern your access to and use of the website, customer portal, maintenance plans, and services provided by Restore Heating & Cooling ("Restore," "we," "us," or "our"). Please read them carefully.

By accessing or using our Services, requesting service, or purchasing a maintenance plan, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Services

Restore provides heating, ventilation, and air conditioning (HVAC) repair, installation, and maintenance services in Greenville, South Carolina and the surrounding Upstate area. Our website and customer portal allow you to request service, view service history, manage maintenance plans, and pay invoices.

Service availability, appointment times, and diagnostic findings are estimates and are not guaranteed until confirmed by a technician on site.

2. Accounts and Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree to provide accurate, current, and complete information and to keep it updated.

3. Service Requests and Estimates

  • Requests submitted through the website or chat are appointment requests, not confirmed bookings, until we contact you to schedule.
  • Estimates provided before an on-site diagnosis are approximate. Final pricing is confirmed after inspection and, where applicable, your authorization.
  • You are responsible for providing safe, reasonable access to the equipment to be serviced.

4. Maintenance Plans

We offer Bronze, Silver, and Gold maintenance plans on a monthly or annual subscription basis. Plan features, pricing, and included visits are described at the time of purchase.

  • Subscriptions renew automatically for the selected billing period (monthly or annual) until canceled.
  • Monthly plans may be canceled at any time and remain active through the end of the current billing period.
  • Annual plans are billed once per year and are non-refundable except as required by law or as expressly stated at purchase.
  • Plan discounts apply only while the plan is active and are not retroactive to prior work.
  • We may adjust plan pricing or features with advance notice; changes take effect on your next renewal.

5. Payments and Invoices

Payments are processed through our third-party payment processor. You authorize us to charge your selected payment method for services rendered, subscriptions, and applicable taxes.

Invoices are due upon receipt unless otherwise agreed in writing. Late or unpaid balances may be subject to additional charges permitted by law and may result in suspension of Services or plan benefits.

6. Cancellations and Refunds

If you need to cancel or reschedule an appointment, please notify us as early as possible. Refunds for completed services are handled on a case-by-case basis consistent with applicable law and any workmanship warranty described below.

7. Workmanship and Warranties

We stand behind our work. Any workmanship warranty for a specific repair or installation will be described on the applicable invoice or agreement. Manufacturer warranties on parts and equipment are provided by the manufacturer and subject to their terms.

EXCEPT AS EXPRESSLY STATED, THE SERVICES ARE PROVIDED “AS IS” AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY LAW.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RESTORE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

Our total liability for any claim arising out of the Services will not exceed the amount you paid to us for the specific service giving rise to the claim.

9. Emergency Services

If you have a gas smell, carbon monoxide alarm, or other safety emergency, stop using the equipment, leave the area if necessary, and call emergency services or our emergency line immediately. Online requests and chat are not monitored in real time and should not be used to report emergencies.

10. Acceptable Use

  • Do not use the Services for any unlawful purpose or in violation of these Terms.
  • Do not attempt to disrupt, reverse engineer, or gain unauthorized access to the Services or related systems.
  • Do not submit false, misleading, or fraudulent information.

11. Intellectual Property

The website, content, logos, and materials are owned by Restore or its licensors and are protected by intellectual property laws. You may not copy, reproduce, or distribute them without our written permission.

12. Third-Party Services

The Services rely on third-party providers for authentication, payments, hosting, and communications. Your use of those features may also be subject to the third parties' terms. We are not responsible for third-party services outside our control.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of laws rules. You agree that any dispute will be resolved in the state or federal courts located in Greenville County, South Carolina, and you consent to their jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
